Recent changes to truck safety laws have imposed a new general safety duty on trucking businesses and other parties in the chain of responsibility. This new safety duty applies to maintenance as well as other public risks.
The penalties for non-compliance will be very high. The maximum penalty for a corporation if recklessness is involved will be $3 million. The maximum penalty for an individual will be $300,000 or five years’ imprisonment or both.
